These Terms govern your use of gameday.agency, portal.gameday.agency (together, the “Sites”), and the services of Agency Automation LLC, a Florida limited liability company doing business as GameDay (“GameDay,” “we,” “us”). By using the Sites or our services, you agree to these Terms. If you don’t agree, don’t use them.
1. Who we are
GameDay operates a TikTok LIVE Creator Network through Agency Automation LLC. We are an independent company. We are not TikTok, and we are not owned by, endorsed by, or acting on behalf of TikTok or its affiliates. TikTok is a trademark of its owner.
2. Eligibility
You must be at least 18 years old and live in the United States to apply to, join, or use our services.
3. Applying and joining
Applying does not guarantee acceptance. We decide whom to invite, and TikTok separately reviews each creator’s eligibility and makes its own decisions. Your participation in TikTok’s Creator Network program is also governed by TikTok’s own terms, which are between you and TikTok.
4. Portal accounts
Access to the portal is by invitation. You agree to give accurate information, keep your login secure, and take responsibility for activity on your account. We may suspend or remove portal access at any time, including when you leave our network.
5. No earnings promises
We do not guarantee results, earnings, rewards, or growth of any kind. Any earnings from TikTok are paid to you by TikTok under its terms. Examples, tips, and coaching we share are guidance only, not promises.
6. Your conduct
When using the Sites or our services, you agree not to:
- Break the law, TikTok’s Terms of Service, or TikTok’s Community Guidelines.
- Misrepresent your identity or age, or use someone else’s account.
- Create or use additional accounts to get around eligibility rules.
- Harass, threaten, or pressure other members, or share their information outside the portal.
- Post content that is sexual, unlawful, infringing, or harmful.
- Offer or arrange gifting services, coin or recharge sales, or payments outside TikTok.
- Scrape, copy, disrupt, or try to gain unauthorized access to the Sites.
7. Content you share
You keep ownership of content you post in the portal, such as messages and collab posts. You give us a limited license to host and display that content within the portal so we can provide our services. You are responsible for what you post, and we may remove content that breaks these Terms.
8. Embedded TikTok content
Parts of the Sites may show TikTok LIVE streams through TikTok’s official embedded player. That content belongs to its creators and TikTok. Your use of it, including chatting or sending gifts in the TikTok app, is governed by TikTok’s terms and privacy policy.
9. Scout program
If you take part in our scout program, your Scout Independent Contractor Agreement also applies. If it conflicts with these Terms on a scouting matter, that agreement controls.
10. Our content
The Sites, our brand, and the materials we provide belong to GameDay. You may use them only as part of our services and may not copy or redistribute them without our permission.
11. Third-party services
The Sites may link to or rely on services we don’t control, including TikTok. We are not responsible for those services or their content.
12. Disclaimers
The Sites and our services are provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law.
13. Limitation of liability
To the fullest extent permitted by law, GameDay will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or earnings. Our total liability for any claim relating to the Sites or these Terms will not exceed $100.
14. Indemnification
You will indemnify and hold harmless GameDay, its owners, and staff from claims, losses, and expenses, including reasonable attorneys’ fees, arising from your breach of these Terms or your misuse of the Sites.
15. Ending your use
You may stop using the Sites at any time. We may suspend or end your access if you break these Terms or leave our network. Sections that by their nature should continue, including 5, 7, and 10 through 16, survive.
16. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be brought only in the state or federal courts located in Florida.
17. Changes
We may update these Terms. We’ll post the new version here with a new effective date. Continuing to use the Sites after an update means you accept it.
